Privacy Policy

This Privacy Policy explains how Nick F. Nelson LLC, doing business as Brandprenuer Studio AI (“we,” “us”), collects, uses, shares, retains and deletes personal information when you use Brandprenuer Studio AI (the “Service”). It forms part of our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms.

1. Information we collect

• Account information: name, email address, password (stored hashed), and account settings.
• Photos and Likeness data (“Inputs”): your Brand-Ready Vault Anchors, uploaded photos, and Borrow the Look inspiration images.
• Outputs: the portraits, edits, crops, upscales and exports generated for you.
• Consent record: the Terms version you accepted, date and time, method of acceptance, IP address and device/browser information, and your marketing choice.
• Billing information: purchase history and payment status. Card details are handled by our payment processor (Stripe) and never stored by us.
• Technical information: session identifiers used to enforce one active device per account, and basic logs needed for security and troubleshooting.

2. Biometric and facial data

Facial images, facial geometry and Likeness data may be considered biometric identifiers, biometric information or sensitive personal information in some jurisdictions (including under the Illinois Biometric Information Privacy Act, Texas and Washington biometric privacy laws, and similar statutes). We collect this information only with your express written consent given at our consent gate, and only to generate and deliver Outputs you request. We:

• Do not sell, lease, trade or otherwise profit from facial images, Likeness data or biometric information;
• Do not use it to train, fine-tune or improve any AI model, and our AI Providers are contractually restricted from doing so;
• Do not use it for identification, surveillance or facial recognition;
• Limit access to authorised personnel and service providers who need it to provide the Service;
• Retain it only while your account is active or as needed to provide the Service; and
• Permanently destroy it within 30 days of a verified deletion request or account closure, and in any event no later than 3 years after your last interaction with the Service, subject to Section 6.

3. How we use information

• To operate the Service: store your Vault and galleries, and generate, edit, crop, upscale and export Outputs at your request;
• To resolve historical human-finishing orders, including fulfillment, receipts, settlement and refunds; no new human-finishing orders are offered;
• To process payments, credits and refunds;
• To secure accounts, prevent fraud and misuse, and provide support;
• To keep a record of your agreement to our Terms; and
• To comply with law.

We use selected Outputs or before-and-after materials for marketing only if you give the separate, optional marketing consent. You can withdraw it at any time in your Account settings or by emailing legal@brandprenuerstudios.com.

4. AI processing and service providers

To generate a portrait, your Inputs and instructions are sent securely to our AI Providers (currently Google’s commercial generative AI services, accessed through our platform provider) for processing. Under their commercial terms, request data is not used to train their foundation models. Providers may keep request data or logs for limited periods under their own terms; we have not independently verified those periods and do not promise zero retention. We also use: our cloud hosting and database provider (private storage of accounts, Anchors and Outputs); Stripe (payments); and email delivery providers (sign-in and account emails). Each acts on our behalf and may use your information only to provide services to us.

We do not sell or “share” personal information for cross-context behavioural advertising.

5. Storage and security

Anchors and Outputs are stored in private cloud storage protected by authentication, encryption in transit, and row-level security so that only your authenticated account (and authorised administrators for support) can access them. No system is perfectly secure, and we cannot guarantee absolute security.

6. Retention and deletion

We keep your content while your account is active. Your account, credits and saved images remain when a membership is paused or cancelled. In-app image deletion is not currently available. To delete specific images, or your account and all associated content, email nick@brandprenuer.com; we process verified requests within 30 days. When an image is deleted it is removed from active storage. Limited records and backups may persist for up to 30 days for disaster recovery, fraud prevention, billing and legal compliance, or longer where required by law or to defend legal claims.

7. Your rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to withdraw consent, and to not be discriminated against for exercising these rights. To exercise any right, email nick@brandprenuer.com. We will verify your request and respond as required by applicable law.

8. Children

The Service is for adults 18 and over. Images of minors may not be uploaded. If we learn that we hold such images, we will delete them.

9. International users

We are based in the United States and process information there and wherever our service providers operate.

10. Changes

We may update this Policy. If changes are material we will notify you in the app or by email and, where required, ask for your consent again.
